NSW Government Crown Lands Department

The creation of a government-owned corporation from other forms of government ownership may be a precursor to privatisation.

Postpone the Government's proposals to allow the largest sell-off & privatisation of Crown (public) land in our history UNTIL you supply the public with a complete list of all Crown land in NSW.

There is a distinction to be made between state ownership and public property. The former may refer to assets operated by a specific organisation of the state used exclusively by their operators or that organisation, such as a research laboratory, while public property refers to assets and resources that are available to the entire public for use, such as a public park, sporting fields, and reserves.

Owing to the size and diversity of the state there is no complete list of crown land available for sale. There are district offices that cover all areas of the state and local knowledge is often required as to the suitability of the land available for what the person requires it for.

Should you have a specific area you wish to purchase in please forward the lot/dp or a very accurate description so the parcel/s are identifiable to us and that will be forwarded to the District Office for the area who will respond to your enquiry.

Kind Regards,

The Gateway Review

Over Rides Community & Councils

STEPS IN THE PROCESS

The gateway process has the following steps:

  • Planning proposal — the relevant planning authority is responsible for the preparation of a planning proposal, which explains the effect of and justification for the plan. If initiated by the Minister (rather than the local council which is mostly the case) the Minister can appoint the Secretary of the Department of Planning & Environment or a joint regional planning panel to be the relevant planning authority.
  • Gateway — The Minister (or delegate) determines whether the planning proposal is to proceed. This gateway acts as a checkpoint to ensure that the proposal is justified before further studies are done and resources are allocated to the preparation of a plan. A community consultation process is also determined at this time. Consultations occur with relevant public authorities and, if necessary, the proposal is varied.
  • Community consultation — the proposal is publicly exhibited (generally low impact proposals for 14 days, others for 28 days). A person making a submission may also request a public hearing be held.
  • Assessment — The relevant planning authority considers public submissions and the proposal is varied as necessary. Parliamentary Counsel then prepares a draft local environmental plan — the legal instrument.
  • Decision — With the Minister’s (or delegate’s) approval the plan becomes law and is published on the NSW legislation website.

  • No people consultation, no transparency, no local knowledge of Site they approve, most applications are approved (192 out of 200), major developers prefer this process. Crown Land and Gateway Review needs to be referred to ICAC for transparency of process.

From the Better Planning Network here is the questions to ask your local member.

As a group or an individual, we encourage you to take action now and as a first step, to write to your local MP requesting that they make representations on your behalf to the Minister for Planning, in order to seek clarification on questions such as:

  • What is the aim of the review of the pre-gateway process?
  • What are its terms of reference?
  • Will submissions from the public be invited?
  • What is its timeline?
